Welcome to The Healing Artisan. By accessing or using our website (thehealingartisan.com), creating an account, purchasing our products (including impasto artwork, apothecary products/candles, jewelry, etc.), or using our services, you agree to be bound by the following Terms and Conditions. Please read them carefully before making a purchase.

1. General Conditions & Account Creation

Eligibility: By using this site, you represent that you are at least the age of majority in your state or province of residence.
User Accounts: You may register for an account on our website (powered by WordPress and WooCommerce) to track order history and manage your details. You are responsible for maintaining the confidentiality of your account login information and for all activities that occur under your account.
Refusal of Service: We reserve the right to refuse service, terminate accounts, or cancel orders at our sole discretion.

2. Product Information & Disclaimers

Artwork

We make every effort to display the colors, textures, and details of our original artwork (including impasto paintings) as accurately as possible. However, due to differences in monitor displays and lighting, we cannot guarantee that your device’s screen will perfectly match the physical product.

Jewelry Materials & Allergen Safety

We explicitly list the materials and metal types used in each piece of jewelry within the individual product descriptions (which may include brass, copper, nickel, silver, or plated materials).

Customer Responsibility: It is the customer’s responsibility to read product descriptions carefully prior to purchase if they have known skin sensitivities or allergies.
Limitation: The Healing Artisan is not responsible for any allergic reactions, skin discoloration, irritation, or medical conditions resulting from wearing our jewelry. If skin irritation occurs, discontinue use immediately.

Apothecary & Candle Specifications

All candles and apothecary items are handcrafted. Slight variations in appearance, color, texture, or scent throw are normal characteristics of handmade goods and do not constitute a product defect.

3. Candle Safety & Assumption of Risk

By purchasing and using our candles, you explicitly acknowledge and agree that open flames are inherently hazardous if used improperly, and you assume all risks associated with their use.

Candle Burning Instructions:

Trim the Wick: Trim the wick to ¼ inch (6mm) before every single lighting.
Clean Wax Pool: Keep the wax pool completely free of matches, wick trimmings, and debris.
Burn Time: Never burn a candle for more than 4 hours at a time.
End of Use: Stop burning the candle when only ½ inch (12mm) of wax remains at the bottom of the container.
Placement: Place candles on a flat, heat-resistant surface while burning. Avoid drafty areas, open windows, ceiling fans, or air currents.
Container Warning: Metal and glass containers will become hot to the touch during use. Never move a burning candle or a container while the wax is still liquid or hot.
Unattended Flame: Never leave a burning candle unattended.

4. Orders, Shipping & Returns

All Sales Final: All purchases made through The Healing Artisan are final. We do not accept returns, exchanges, or refunds once an order has been placed and processed.
Shipping Destinations: We currently ship exclusively to addresses within the United States. We do not offer international shipping at this time. Shipping policies and available destinations are subject to change in the future.
Third-Party Payments: Payments are processed securely via third-party providers (including PayPal). By submitting your payment details, you agree to abide by the applicable terms and privacy policies of those third-party payment gateways.

5. Reviews & User Submissions

Reviews and user comments may be disabled on the website at our discretion. If enabled, any feedback, reviews, or submissions you provide grant us a non-exclusive right to display, publish, or use that content in connection with our business operations. We reserve the right to remove any submission deemed offensive, inappropriate, or spam.

6. Limitation of Liability

To the maximum extent permitted by applicable law, The Healing Artisan, its owners, and employees shall not be liable for any indirect, incidental, special, consequential, or punitive damages—including but not limited to property damage, fire damage, personal injury, medical bills, or loss of profits—arising out of or connected to the use, misuse, or inability to use our products, even if advised of the possibility of such damages.

In no event shall the total aggregate liability of The Healing Artisan exceed the actual dollar amount paid by you for the specific product that gave rise to the claim.

7. Indemnification

You agree to indemnify, defend, and hold harmless The Healing Artisan and its owners from any and all claims, liabilities, damages, costs, and expenses (including reasonable legal fees) arising from your violation of these Terms, your misuse of our products, or your negligence.

8. Governing Law & Dispute Resolution

These Terms and Conditions and any separate agreements whereby we provide you products or services shall be governed by and construed in accordance with the laws of the State of California, without regard to conflicts of law principles. Any legal action arising from or related to these terms or our products must be filed in the courts located in Shasta County, Redding, California.

9. Changes to Terms

We reserve the right to update, change, or replace any part of these Terms and Conditions at any time by posting updates to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.
